Court of Protection

The Court of Protection oversees the estates of individuals who have lost their mental capacity.  It is still possible to make an Enduring Power of Attorney but from 1st October 2007 the Mental Capacity Act 2005 introduces the Lasting Power of Attorney. Enduring Powers of Attorney made before that date will continue to be valid, but after that date it will only be possible to make Lasting Powers of Attorney.  There are various important differences between the two regimes.  The Lasting Power of Attorney is capable of dealing with an individual’s personal welfare matters and decisions as well as their financial affairs.  Enduring Powers of Attorney may only deal with financial affairs. contact us and let us guide you through the process.
